Friends with Benefits — Membership Terms and Conditions

1.0 Membership 

1.1. A person can apply for a ‘Friends with Benefits’ membership by completing details online at www.thewembleyhotel.com.au or www.apothecarybar.au, via the application form or by joining in venue. 

1.2. Members will be bound by these Terms and Conditions, which may vary. The Wembley Hotel and Bar Apothecary will attempt to notify members of changes but shall not be liable in any way for failure to do so. 

1.3. A member must notify The Wembley Hotel or Bar Apothecary of personal detail changes or of a lost or stolen membership card. The Wembley Hotel and Bar Apothecary is not liable for delays in replacing a membership card or for any unauthorised use. 

1.4. Points will not be credited until an individual becomes a member. Members can check point balances by asking a staff member or via online login. Disputes regarding member’s points must be notified to The Wembley Hotel or Bar Apothecary at mya@hazycorp.au. A written statement by The Wembley Hotel and Bar Apothecary deciding any such dispute is final and binding. 

1.5. The Wembley Hotel and Bar Apothecary may terminate a membership without notice for any reason including, without limitation, if the member: 

1.5.1. Fails to comply with these membership Terms and Conditions 

1.5.2. Abuses any privilege accorded to the member, or 

1.5.3. Supplies any misleading information or make any misrepresentations to The Wembley Hotel and Bar Apothecary staff or management. 

1.5.4. or if the member does not use his or her membership card for a period of 12 months. 

1.6. A member may terminate his or her membership at any time by giving written notice to The Wembley Hotel or Bar Apothecary at mya@hazycorp.au 

1.7. Membership cards are not credit cards, not transferable, cannot be redeemed as cash and remain the property of The Wembley Hotel and Bar Apothecary. 

1.8. Any tax, liability, or duty arising from a member's participation in the 'Friends with Benefits' membership program, is the responsibility of the member. 

2.0 Earning points and Redeeming points 

2.1. Points will be credited to member’s account for purchases on qualifying goods and services. 

2.2. The Wembley Hotel and Bar Apothecary will determine which goods or services are qualifying and the number of points credited. 

2.3. A member must present their membership card to The Wembley Hotel or Bar Apothecary staff before purchase is concluded. Failure to present the card results in no points being credited. 

3.0 Other deductions of points 

3.1. The Wembley Hotel and Bar Apothecary can deduct points from a member if points credited were in error, refund is given or purchase cancelled. 

3.2. Any member not active within 12 months will have their entire points balance expired. 

4.0 General 

4.1. The Wembley Hotel and Bar Apothecary, without prior notice to members, can change the goods and services which qualify for points and the number of points awarded. 

4.2. The Wembley Hotel and Bar Apothecary reserves the right to suspend or terminate the membership program at any time without notice. The Wembley Hotel and Bar Apothecary will not be liable for the suspension or termination of the program on any account whatsoever including (without limitation) for any points balance in a member’s account at the time of suspension or termination. 

4.3. The Wembley Hotel and Bar Apothecary assumes no liability to a member whether for negligence, breach of contract or otherwise except: 

4.3.1. Any claim relating to points, to crediting that number of points to the member’s account. 

4.4. A notice shall be deemed to be given by The Wembley Hotel and Bar Apothecary to a member if it is sent to the postal or e-mail address of the member appearing in the database. 

5.0 Privacy Statement 

5.1. The Wembley Hotel and Bar Apothecary may collect information about members. The membership database contains the following member information: 

5.1.1. Name, address and telephone number(s) 

5.1.2. Transaction details associated with the collection of membership program points 

5.1.3. Points collected and awards provided. 

5.1.4. E-mail address 

5.2. Member database information will be made available to The Wembley Hotel and Bar Apothecary agents involved in administering the membership program. Information from the membership database will be made available to and used by The Wembley Hotel and Bar Apothecary and its agents, for marketing, planning, product development, research and other commercial purposes. 

5.3. Each member consents and agrees to: 

5.3.1. The Wembley Hotel and Bar Apothecary and its agents including Zen Global accessing the information contained in the member database; 

5.3.2. The disclosure of any information contained in the member database to The Wembley Hotel and Bar Apothecary, Zen Global and its agents for the purposes set out above; and 

5.3.3. The disclosure of any information contained in the member database by The Wembley Hotel and Bar Apothecary, Zen Global or its agents for the purposes referred to above. 

6.0 Liability & Disclaimer 

6.1. To the fullest extent permitted by law, The Wembley Hotel and Bar Apothecary excludes all liability for any loss, damage or injury suffered by a member arising directly or indirectly from participation in the ‘Friends with Benefits’ membership program. 

6.2. Where liability cannot be excluded, any liability will be limited to the minimum extent permitted by law. 

7.0 Changes to Program 

7.1. The Wembley Hotel and Bar Apothecary reserves the right to vary, amend or cancel any aspect of the ‘Friends with Benefits’ membership program, including benefits, points structure and rewards at any time without notice. 

8.0 Acceptance of Terms 

8.1. By applying for and/or using a ‘Friends with Benefits’ membership, the member acknowledges that they have read, understood and agree to be bound by these Terms and Conditions. 

9.0 Marketing Communications 

9.1. By becoming a member, the member agrees to receive marketing and promotional communications from The Wembley Hotel and Bar Apothecary. Members may opt out at any time via unsubscribe links or by contacting the venue directly. 

10.0 Points Accrual 

10.1. Points accrue only on the value of qualifying purchases actually paid by the member and cannot be earned on unpaid, complimentary, discounted-to-zero, or gift-card-funded transactions unless expressly stated otherwise. 

10.2. Points do not accrue on the purchase of gift cards, vouchers, or top-ups themselves; points accrue only when a gift card or voucher is redeemed against a qualifying purchase. 

10.3. The rate at which points accrue (e.g. points per dollar spent) is set by The Wembley Hotel and Bar Apothecary and may differ between venues, products, promotional periods, and days of the week. 

10.4. Points may take a reasonable processing period to appear on a member’s account following a qualifying purchase and are not guaranteed to be credited instantly. 

10.5. Points have no cash value, cannot be sold, transferred between members, combined between accounts, or exchanged for cash, and expire in accordance with clause 3.2. 

11.0 Offers, Promotions and Rewards 

11.1. All offers, promotions, rewards, and redemption values are provided at the sole discretion of The Wembley Hotel and Bar Apothecary and may be withdrawn, varied, capped, or declined at any time without notice or reason. 

11.2. Offers may be subject to availability, blackout dates and times (including public holidays, private functions, and major events), minimum spend requirements, and may not be used in conjunction with any other offer, discount, or promotion unless expressly stated. 

11.3. The Wembley Hotel and Bar Apothecary reserves the right to refuse to honour an offer or reward where it reasonably suspects fraud, misuse, abuse of the program, or a breach of these Terms and Conditions. 

11.4. Management reserves the right to refuse service or entry in accordance with standard venue conditions of entry and applicable responsible service of alcohol obligations, regardless of membership status. 

12.0 Eligibility 

12.1. Membership is only available to individuals aged 18 years or over. The Wembley Hotel and Bar Apothecary may request proof of age and identity at any time and may suspend or terminate a membership where proof cannot be provided. 

12.2. Employees of The Wembley Hotel, Bar Apothecary, and Hazy Corp, and their immediate families, may be excluded from participating in specific promotions at management’s discretion. 

13.0 Fraud and Misuse 

13.1. Any attempt to earn or redeem points by fraudulent, dishonest, or improper means (including use of another person’s membership card) may result in forfeiture of points, suspension or termination of membership, and may be referred to the relevant authorities. 

14.0 Limitation of Liability 

14.1. To the extent permitted by law, The Wembley Hotel and Bar Apothecary is not liable for any indirect, incidental, or consequential loss arising from a member’s participation in, or inability to access, the program, including loss arising from system outages, technical errors, or third-party service disruptions. 

15.0 Governing Law 

15.1. These Terms and Conditions are governed by the laws of Western Australia, and members submit to the non-exclusive jurisdiction of the courts of Western Australia. 

16.0 Terms Subject to Change 

16.1. All content of this document, including but not limited to membership benefits, points structures, offers, rewards, and these Terms and Conditions themselves, is subject to change by The Wembley Hotel and Bar Apothecary at any time without notice. Continued use of a membership after any change constitutes acceptance of the updated Terms and Conditions.
